Terms of Service

These terms govern your use of MergeBird ("the Service"), operated by Black Hart Consulting ("we," "us"). By installing or using MergeBird, you agree to them.

1. The Service

MergeBird is an Outlook add-in that sends personalized email from your own Microsoft 365 mailbox. Your email content, recipients, and attachments are processed on your device and sent via Microsoft's APIs; they do not pass through our servers. See our Privacy Policy.

2. Your account & responsibilities

You are responsible for your Microsoft account, the accuracy of your recipient data, and all activity conducted through MergeBird under your mailbox.

3. Acceptable use

You agree not to use MergeBird to send spam or unsolicited bulk email, or for any unlawful, deceptive, or abusive purpose. You are solely responsible for complying with all applicable laws, including anti-spam and privacy laws such as CAN-SPAM, CASL, and GDPR — including obtaining any required consent and honoring unsubscribe requests. You must respect Microsoft's sending limits and acceptable-use policies.

4. Plans, billing & refunds

MergeBird offers a free tier and paid plans (subscriptions and one-time credit packs) billed through Stripe. Subscriptions renew automatically until cancelled; you can cancel any time and retain access through the paid period. Credit packs are one-time and do not expire. If something isn't right, contact us within 14 days of a charge and we'll make it right.

5. Availability

We work to keep MergeBird available and reliable, but the Service is provided "as is" without warranties of any kind. Sending speed and deliverability are ultimately governed by Microsoft 365 and the recipients' mail servers.

6. Limitation of liability

To the maximum extent permitted by law, Black Hart Consulting is not liable for any indirect, incidental, or consequential damages, or for any lost emails, data, or revenue arising from your use of the Service. Our total liability is limited to the amount you paid us in the preceding 12 months.

7. Termination

You may stop using and remove MergeBird at any time. We may suspend or terminate access for violations of these terms.

8. Changes

We may update these terms; we'll revise the "last updated" date and, for material changes, provide notice. Continued use after changes means you accept them.
